Vermeer® Round Hay Baler

According to reports, scores of farmers and laborers have been seriously injured by the Vermeer® baler due to problems with twine clogging and irregular feeding through the pinch rollers. When the twine clogs, the operator must manually feed the twine through the baler’s very dangerous pinch rollers. This can only be accomplished while the machine is in operation.

In an attempt to fix the machine, over 100 individuals have had limbs or hair caught in the pinch rollers of the baler. These injuries have happened because the pinch rollers are turning so fast and grabbing the twine and hay so quickly that operators do not have ample time to react and let go. The results can be horrific. A number of individuals, including a Law Offices of Stuart A. Kritzer client who had one arm traumatically amputated and the other rendered largely useless while trapped in the running machine for over an hour, have been killed, scalped and/or otherwise disfigured and maimed.

The Law Offices of Stuart A. Kritzer investigation and suit against Vermeer® confirmed the company knew that because of the defective design of its machine, people had to put their hands near the baler’s pinch rollers in order to correct some malfunctions. There was no adequate warning and no safe alternative means of doing so. A safer model later replaced this machine, although Vermeer® never recalled the nearly 30,000 dangerously designed ones already in use.

In addition to Vermeer® not adequately warning users of the danger, it is believed that the design of its Round Hay Baler had defects that created an unreasonably dangerous condition not readily apparent to a user. Before marketing and selling the product, the manufacturer never conducted a hazard analysis or other appropriate safety engineering study.
